The ground rules for using our site and buying from us. We've kept them as readable as we can.

These terms apply to the Arthur Pembroke website and to every order placed through it. By using the site or placing an order you agree to them. If you don't agree, please don't use the site.

Who can order

You must be at least 18 years old and able to enter a binding contract to place an order. By ordering, you confirm that the information you give us is accurate and that you're authorised to use the payment method provided.

Products and pricing

All prices are in US dollars and exclude sales tax, which is calculated at checkout where applicable. We do our best to display colours and details accurately, but screens vary and a garment may look slightly different in person.

Occasionally a price or description is listed in error. If that happens with something you've ordered, we'll contact you before shipping to let you confirm at the correct price or cancel for a full refund. We reserve the right to cancel orders placed at an obviously incorrect price.

Orders and acceptance

Placing an order is an offer to buy. We accept it when we send your shipping confirmation — until then we can decline or cancel an order for reasons including stock availability, suspected fraud, or errors in pricing. If we cancel an order you've paid for, we refund you in full.

Payment

Payment is taken in full when you place your order. We accept the payment methods shown at checkout. Our Billing Terms set out the details.

Shipping, returns and exchanges

Delivery times, costs and our sixty-day return promise are set out in our Shipping Policy and Returns & Refund Policy, which form part of these terms.

Our content

Everything on this site — the Arthur Pembroke name and emblem, photography, product designs, copy and layout — belongs to us or our licensors and is protected by copyright and trademark law. You may browse and shop, but you may not copy, reproduce or use our content for any commercial purpose without our written permission.

Acceptable use

You agree not to use the site for anything unlawful, to interfere with its operation, to attempt to gain unauthorised access to any part of it, or to place fraudulent orders. We may suspend access for anyone who does.

Disclaimer

We work hard to keep the site accurate and available, but it's provided "as is". We don't guarantee it will be error-free or uninterrupted, and we're not responsible for content on third-party sites we link to.

Limitation of liability

To the fullest extent permitted by law, our liability to you in connection with any order is limited to the amount you paid for that order. We're not liable for indirect or consequential losses. Nothing in these terms limits any liability that can't be limited by law, including for death or personal injury caused by negligence.

Governing law

These terms are governed by the laws of the State of New York, and any dispute will be dealt with by the courts of New York. If you have a problem, please contact us first — we'd much rather sort it out directly.
